Temporary Schedule Change for November 12th and 26th

The 1:00 - 4:00 PM Open Court sessions on these two days will not be held in order to move Protection Order hearings from the preceding Thursdays to these time slots. This could change if there are no Protection Order hearings on one or both of these weeks. Defendants are encouraged to call closer to these dates to inquire if the Open Court sessions will be available.


COVID-19 UPDATED STANDING ORDER

During COVID, the court significantly limited personal appearances.  The State of Montana and the Montana Supreme Court have lifted their restrictions.  Therefore, Missoula Municipal Court will be making some changes in policy.

 

    • Defendant’s will continue to have the option of appearing by video in most cases.  The exceptions are described below:

       

      • Unless otherwise ordered, Initial Appearances and Appearances on Warrants for the following charges must be in person: Personal appearance will also be required to address warrants issued for failing to comply with Work Release Jail sentencing.

         

        • PFMA

        • Assault

        • Violation of a Restraining Order

        • Sexual Assault

        • Violation of a No Contact Order

        • Stalking

        • DUI

        • Surreptitious Visual Observation

        • Indecent Exposure

        • Privacy in Communications 

           

      • Change of Pleas that involve the possibility of jail, or an argument for jail alternatives, will require a personal appearance by the defendant.

         

      • Appearances on Petitions to Revoke will require a personal appearance by the defendant.

         

      • Contested hearings, trials, and hearings regarding Orders of Protection will require personal appearance of the parties and attorneys unless otherwise ordered by the court.

        • NOTE:  If contested matters or trials are allowed to be electronic, the court WILL NOT admit evidence that has not been filed the day prior to the hearing.   

           

      • Attorneys may appear in person or by video for non-contested hearings.

  • If you do not contest the charge, most tickets can be addressed either by phone (406) 552-6180 or online at http://citepayusa.com without seeing a judge. It is the court's current  policy to defer for six months charges that are paid online. Please note that a phone call to the court is necessary after six months has passed from the day the ticket was paid in order for the charge to be dismissed and points removed from a driving record. If there are new violations within that six month period the charge will not be dismissed.
    • Payment agreements can be made by speaking with a court clerk by phone for most tickets.
    • Payments can be made through Citepay (www.citepayusa.com) , at the counter (Visa, MasterCard, cash, check, or Money Order), by mail, or by using the drop box in the hallway to the left of the doors into the counter area.  Please complete one of the envelopes provided.
  • Persons who received a citation with charges requiring an appearance before a judge should call or email the court. 
  • Persons who are required or choose to appear before a judge may do so during Open Court sessions which are held on Mondays 8:30 - 11:30, Wednesday 1:00 - 4:00, and Fridays 8:30 - 11:30 and 1:00 - 4:00. To appear during one of these sessions please call or come to the counter on the day you wish to appear. Open Court appearances cannot be scheduled in advance. These sessions often fill up quickly so it is recommended to contact the court shortly after the office opens at 8:00 AM. Persons who are required or choose to appear in person rather than via Zoom must check in at the counter for the appearance to be set. Only those appearing via Zoom may call the court to schedule an appearance.
